All offered services are contingent upon availability and prevailing weather conditions. We hold the authority to alter or cease services without prior notification.
3. Booking and Reservations
3.1 Booking Process
For reserving a charter, one must:
- Be a minimum of 18 years old
- Supply precise and complete details
- Complete the necessary deposit outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is dependent on our acceptance of payment and our issuance of written confirmation. Service may be declined to anyone at our discretion.
3.3 Availability
Charting a yacht is subject to the accessibility of the vessel and appropriate weather conditions. We will endeavor to meet your requested dates and times as best as we can.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and incorporate applicable taxes unless stated otherwise. Prices are subject to amendments without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter is due when booking
- Balance: Due 48 hours before the departure of the charter
- Any additional charges (if applicable): Payable at the end of the charter
4.3 Payment Methods
Major credit cards, bank transfers, and certified cheques are accepted forms of payment. All payments are processed through secured, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus processing charges
- 24-72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No reimbursement
5.2 Weather Cancellations
Should the conditions be deemed unsafe for sailing by our captain, we will propose to:
- Move your charter to an alternative date at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there are mechanical issues with the designated vessel, we will strive to provide an appropriate replacement. Should no alternative be available, a full repayment will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are expected to:
- Heed all instructions from the crew
- Ensure safety equipment is worn as mandated
- Declare any medical conditions affecting their safety
- Stay within designated spaces on the vessel
6.2 Prohibited Items
Items not permitted onboard encompass:
- Glass containers
- Illicit substances
- Weapons of any kind
- Excessive non-alcoholic drinks (beyond reasonable amounts)
- Pets (unless approved beforehand)
6.3 Conduct
All passengers must act respectfully. We have the right to end a charter prematurely without a refund if a passenger's conduct endangers safety or disturbs the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the amount paid for your charter. We are not accountable for:
- Injuries instigated by a passenger's recklessness
- Theft or destruction of personal property
- Indirect, special, or ensuing damages
- Delays resulting from weather or situations out of our control
7.2 Insurance Coverage
Comprehensive marine insurance that covers our vessels and operations is actively maintained. Passengers should ensure they have adequate travel and personal insurance.
7.3 Assumption of Risk
By participating in our charter services, you recognize the innate risks associated with marine activities and take responsibility for your safety and wellbeing.
8. Modifications and Itinerary Changes
The right is reserved to alter itineraries, paths, or schedules due to environmental conditions, security needs, or operational demands. We will make efforts to offer comparable alternate experiences.
9. Force Majeure
We shall not be accountable for interruptions, cancelations, or adjustments caused by events beyond our immediate control, which include but are not confined to:
- Extreme weather scenarios
- Catastrophic events
- Governmental edicts
- Port shutdowns
- Technical breakdowns
10. Privacy and Data Protection
